Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0600207 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the Religious Assembly- Regional use type and the <br /> Educational Services — General use type may be conditionally permitted in the AU-20 <br /> (Agricultural Urban Reserve, 20 acre minimum) zone with an approved Use Permit <br /> application. The project site has a General Plan designation of Resource Conservation <br /> (OS/RC) but is not practical for excavation as the project site is already within a residentially <br /> developed area and located within the urban community of Tracy. There are no applicable <br /> Master Plans, Specific Plan, Special Purpose Plans, or any other applicable plans which are <br /> within the vicinity of this project. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because additional utility and sanitation systems are not required <br /> in Phase I. The applicant shall enter into an annexation agreement for public services <br /> through the City of Tracy in Phases II and III. Any additional storm water drainage created <br /> by the new improvements shall be retained on-site. Additionally, the Department of Public <br /> Works is requiring dedication to result in a 110-foot-wide-right-of-way from the centerline of <br /> Corral Hollow Road to the property line and dedication to result in an 84-foot-wide-right-of- <br /> way from the centerline of Valpico Road to the property line. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> This finding, can be made because the 20.00 acre parcel involved is of adequate size and <br /> shape to accommodate the proposed use and all yards, building coverage, setbacks and <br /> other requirements of the Development Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for the project found no <br /> potentially significant environmental impacts. <br /> San Joaquin County PA-0600207/Pastor of St. Bernard <br /> Community Development Page 5 <br />
