The owner shall grant easements of sufficient width for all <br /> District facilities which may exist on subject property to <br /> serve as a replacement for any prescriptive and/or unrecorded <br /> easements that are present. All existing recorded or newly <br /> dedicated district easements shall be shown on the Parcel Map <br /> prior to its recording. <br /> d. If the homesite area is lower than the adjacent irrigated <br /> property, a permanent berm or ditch shall be constructed <br /> around the homesite parcel to prevent accidental flooding from <br /> irrigation water. Property owner shall either verify field <br /> elevations or submit a written statement to the District <br /> indicating that the property is question is not subject to <br /> flooding from adjacent irrigated property. <br /> e. A copy of the Parcel Map shall be provided to the District <br /> Engineering Department for review prior to its recordation to <br /> ensure that the above conditions have been satisfied. <br /> 4 . COUNTY COUNSEL <br /> a. Pursuant to Section 66474 . 9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or <br /> annul an approval of the local agency, advisory agency, appeal <br /> board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section <br /> 66499 . 37 of the Government Code. <br />
