Analysis <br /> Backctround <br /> On June 20, 2002, the Planning Commission approved Site Approval Application No. PA-02-6 for a poultry <br /> ranch with a maximum of 12,000 egg laying chickens (Use Type: Animal Raising-Small Animals). The <br /> poultry ranch was originally under enforcement for operating without the benefit of permits. There have <br /> been no animals on the premises for the past 2 years. The applicant has a fifteen (15) foot wide recorded <br /> easement for access along Verigin Road (a private road). <br /> The applicant states that the amount of traffic generated by the poultry ranch is minimal. Poultry feed is <br /> delivered to the ranch by means of a commercial truck 1-2 times per month, and the eggs are taken to <br /> farmers' markets by means of a pickup truck on a weekly basis. <br /> Revision of Approved Actions <br /> The applicant is requesting to remove Condition 1.e.(1), which states that the first one hundred (100)feet of <br /> Verigin Road shall be surfaced and permanently maintained with base material of appropriate depth and <br /> asphalt concrete or Portland cement concrete to provide a durable, dust-free surface. This condition of <br /> approval was required for two reasons. The first reason was to reduce the amount of dust generated by <br /> traffic on Verigin Road. The second reason was to prevent mud and rocks from being dragged onto State <br /> Route 99 East Frontage Road from project-related traffic during the winter seasons. <br /> The Planning Commission required as a condition of approval that a dust retardant be applied to Verigin <br /> Road once per year(Condition 1.k.(1)) to reduce dust. In order to prevent traffic from dragging mud and <br /> rocks onto the frontage road, the Department of Public Works will require the applicant to obtain an <br /> encroachment permit(Conditions 2.e. and f.). This will require the applicant to improve the ultimate right- <br /> of-way of State Route 99 East Frontage Road to San Joaquin County standards from State Route 99 <br /> East Frontage Road to Verigin Road. The Community Development Department is recommending that, <br /> because Condition 1.k.(1)will reduce potential dust impacts to less than significant, and because the <br /> encroachment permit will eliminate excessive mud and rocks from dragging onto State Route 99 East <br /> Frontage Road, the requirement for the paving of the first 100 feet of Verigin Road be eliminated. <br /> The applicant is also requesting a six (6) month time extension to complete the conditions of approval. <br /> The applicant will not be permitted to operate the poultry ranch until all required permits have been <br /> obtained. <br /> San Joaquin County PA-02-61Khan <br /> Community Development Page 3 <br />
