Recommendations <br /> Action <br /> It is recommended that the Planning Commission. <br /> 1. Approve the Negative Declaration; <br /> 2. Approve Revisions of Approved Actions for Site Approval No. PA-02-6 with the Findings and <br /> Conditions of Approval contained in the staff report; and <br /> 3. Approve a six(6) month Time Extension. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the Revision of Approved Actions request to remove <br /> the condition of approval requiring the paving of Verigin Road is consistent with General <br /> Plan policies. The use type (Animal Raising-Small Animals) proposed in application PA- <br /> 02-06 may be conditionally permitted in the AG-40 zone with an approved Site Approval <br /> application. There are no Master Plans, Specific Plans or Special Purpose Plans in the <br /> project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because previously approved condition of approval 1.k. (1) <br /> requites that dust retardant be applied to Verigin Road once a year. In addition, <br /> recommended conditions of approval 2.e. and 2.f. require the applicant to obtain an <br /> encroachment permit to improve the driveway approach (between Verigin Road and State <br /> Route 99 East Frontage Road) in accordance with the requirements of San Joaquin County <br /> Standard R-17. These conditions of approval are adequate to ensure that any potential <br /> impacts to the existing roadway will be mitigated to less than significant. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the property involved has already been determined to <br /> be of adequate size (10 acres) and shape to accommodate the proposed use. The animals <br /> will be contained in two (2) existing buildings, totaling 30,000 square feet. There are no <br /> new buildings proposed for construction for this project. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the poultry ranch may not be operated without the <br /> approval of all necessary departments.
