� V -3- Surface Mining and Reclamation Act Approved Agricultural Excavation Permits shall be subject to the regulations adopted by the State Mining and Geology Board as authorized by the California Surface Mining and Reclamation Act (SMARA) of 1975 (Public Resource Code Section 2710 et seq.), as amended; Public Resource Code Section 2207; and the California Code of Regulations adopted pursuant thereto (Title 14, Section 3500 et seq). The Community Development Department has reviewed the Site Approval application and responses from other agencies, and providing any outstanding issues have been resolved, will approve the project subject to the following conditions: Agricultural Excavation Application No. PA-0700450 was approved by the San Joaquin County Community Development Department on . The effective date of approval is . This approval will expire on , which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain in force. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Corinne King, [209] 953-7509) a. IMPROVEMENT PLAN: Submit an "APPLICATION-SITE IMPROVEMENT PLAN". A fee is required for the Site Plan review. b. APPROVED USE: This approval is for the excavation and removal of 98,876 cubic yards of soil and the reclamation of the land to an agricultural use in two phases. Phase one to be completed in 18 months. Phase two to be completed in 30 months from the date of approval. c. STORM DRAINAGE: Stormwater drainage shall be retained on-site. The drainage pattern and corresponding storm drain improvements shall be shown on the Site Plan. Drainage calculations prepared by a registered civil engineer or architect shall be included.
