� V <br /> -3- <br /> Surface Mining and Reclamation Act <br /> Approved Agricultural Excavation Permits shall be subject to the regulations adopted by <br /> the State Mining and Geology Board as authorized by the California Surface Mining and <br /> Reclamation Act (SMARA) of 1975 (Public Resource Code Section 2710 et seq.), as <br /> amended; Public Resource Code Section 2207; and the California Code of Regulations <br /> adopted pursuant thereto (Title 14, Section 3500 et seq). <br /> The Community Development Department has reviewed the Site Approval application <br /> and responses from other agencies, and providing any outstanding issues have been <br /> resolved, will approve the project subject to the following conditions: <br /> Agricultural Excavation Application No. PA-0700450 was approved by the San <br /> Joaquin County Community Development Department on . The effective date of <br /> approval is . This approval will expire on , which is 18 months from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with, (2) <br /> all necessary building permits have been secured and remain in force, and (3) all <br /> necessary permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. IMPROVEMENT PLAN: Submit an "APPLICATION-SITE IMPROVEMENT PLAN". <br /> A fee is required for the Site Plan review. <br /> b. APPROVED USE: This approval is for the excavation and removal of 98,876 cubic <br /> yards of soil and the reclamation of the land to an agricultural use in two phases. <br /> Phase one to be completed in 18 months. Phase two to be completed in 30 <br /> months from the date of approval. <br /> c. STORM DRAINAGE: Stormwater drainage shall be retained on-site. The drainage <br /> pattern and corresponding storm drain improvements shall be shown on the Site <br /> Plan. Drainage calculations prepared by a registered civil engineer or architect <br /> shall be included. (Development Title Section 9-1135) <br />
