The photographs were <br /> reportedly taken two days following a storm event and depict turbid water in the surface water <br /> drainage that traverses Musco's property flowing through a culvert under 1-580 onto Caltrans' <br /> property. The e-mail indicated that the discharge was an ongoing problem and stated, <br /> ... here are some pic's of the olive plant, this is two days after rain. There brown gunk water is <br /> flowing on and through our property and some silt with it. During a storm it's even worse." <br /> Subsequently, Julie Myrah, Caltrans Storm Water Coordinator, contacted Kipps to coordinate a <br /> Joint inspection of the discharge. On 19 April, Kipps forwarded Caltran's photographs to <br /> Dennis Leikam with Musca. <br /> On 20 April 2006, Lori Oldfather, California Department of Fish and Game (DFG), filed a <br /> Governor's Office of Emergency Services Hazardous Materials Spill Report report' that <br /> 1000 gallons of "saline waste product" spilled from Musco's property: "There is an off property <br /> discharge from olive plant. The product is running down a ditch into the California Aqueduct. <br /> Fish and Game made contact and the responsible will conduct cleanup.
