Evaporation Ponds E, F, and G Tracy, California prepared by Terraphase Engineering,
Inc.in the project design so that there are no significant impacts associated with seismic
events.Additionally, the project will be subject to the Waste Discharge Requirements of
the Central Valley Regional Water Quality Control Board prior to development of the
ponds to ensure that there are no significant impacts to groundwater. In addition, a
referral was sent to the San Joaquin Valley Air Pollution Control District(SJVAPCD).The
project will be required to comply with all SJVAPCD requirements to ensure that there
is no significant impact to air quality, including dust control measures, as applicable.
5) The use is compatible with adjoining land uses.
• This finding can be made because the proposed use will not interfere with nor alter the
current land uses on adjacent properties. Land uses immediately surrounding the
project site are 1-580 to the north/northeast and a warehouse distribution center(Costco,
Safeway and other companies), the California Aqueduct, the Delta Mendota Canai and
open grassland (cattle grazing) to the south. Further south and west of the entire
proposed project area are agricultural lands. A cluster of electrical facilities including
turbines and peaker plants are located about 2.5 miles west of-the MFOC property and
the U.S. Atomic Energy facility (Lawrence Livermore Lab) is located about three miles
south of the property. About four miles to the southeast of the MFOC property are sand
and gravel quarry operations. The proposed use may be conditionally permitted in the
AG-160 zone subject to an approved Use Permit application. The nearest residence is
located-approximately 700 feet east of the project site.
Williamson Act Principles of Compatibility
(1) The use will not significantly compromise the long-term productive agricultural capability of the subject
contracted parcel or parcels or on other contracted lands in agricultural preserves.
• This Principle of Compatibility can be made because the proposed use is for the
production of food and is an agricultural use as defined in the Williamson Act.The use is
an approved use on contracted lands pursuant to Development Title Section 9-1810.3 The
proposed expansion will not impact the long-term productive agricultural capability of
other contracted lands in the agricultural preserves.
(2) The use will not significantly displace or impair current or reasonably foreseeable agricultural
operations on the subject contracted parcel or parcels or on other contracted lands in agricultural
preserves. Uses that significantly displace agricultural operations on the subject contracted parcel or
parcels may be deemed compatible if they relate directly to the production of commercial agricultural
products on the subject contracted parcel or parcels or neighboring lands, including activities such as
harvesting, processing, or shipping.
• This Principle of Compatibility can be::lade because the use will not significantly displace
or impair current or reasonably foreseeable agricultural operations on the subject
contracted parcel or parcels or on other contracted lands in agricultural preserves. The
proposed use is for the farming and processing and of agricultural products on the
contracted parcels.
(3)The use will not result in the significant removal of adjacent contracted land from agricultural or open-
space use. In evaluating compatibility, a board or council shall consider the impacts on noncontracted
lands in the agricultural preserve or preserves.
San Joaquin County PA-1800037/Musco Olive
Community Development Page 7
