Additionally, the project will be subject to the Waste Discharge <br /> Requirements of the Central Valley Regional Water Quality Control Board prior to <br /> development of the ponds to ensure that there are no significant impact to <br /> groundwater. <br /> 5) The use is compatible with adjoining land uses. <br /> • This finding can be made because the proposed use will not interfere with nor alter the <br /> current land uses on adjacent properties. Land uses immediately surrounding the <br /> project site are 1-580 to the north/northeast and a warehouse distribution center <br /> (Costco, Safeway and other companies), the California Aqueduct, the Delta Mendota <br /> Canal and open grassland (cattle grazing) to the south. Further south and west of the <br /> entire proposed project area are agricultural lands. A cluster of electrical facilities <br /> including turbines and peaker plants are located about 2.5 miles west of the MFOC <br /> property and the U.S. Atomic Energy facility (Lawrence Livermore Lab) is located <br /> about three miles south of the property. About four miles to the southeast of the MFOC <br /> property are sand and gravel quarry operations. The proposed use may be <br /> conditionally permitted in the AG-160 zone subject to an approved Use Permit <br /> application. The nearest residence is located approximately 700 feet east of the project <br /> site. <br /> Williamson Act Principles of Compatibility <br /> (1) The use will not significantly compromise the long-term productive agricultural capability of the <br /> subject contracted parcel or parcels or on other contracted lands in agricultural preserves. <br /> • This Principle of Compatibility can be made because the proposed use is for the <br /> production of food and is an agricultural use as defined in the Williamson Act. The use is <br /> an approved use on contracted lands pursuant to Development Title Section 9-1810.3 <br /> The proposed expansion will not impact the long-term productive agricultural capability <br /> of other contracted lands in the agricultural preserves. <br /> (2) The use will not significantly displace or impair current or reasonably foreseeable agricultural <br /> operations on the subject contracted parcel or parcels or on other contracted lands in agricultural <br /> preserves. Uses that significantly displace agricultural operations on the subject contracted parcel <br /> or parcels may be deemed compatible if they relate directly to the production of commercial <br /> agricultural products on the subject contracted parcel or parcels or neighboring lands, including <br /> activities such as harvesting, processing, or shipping. <br /> • This Principle of Compatibility can be made because the use will not significantly <br /> displace or impair current or reasonably foreseeable agricultural operations on the <br /> subject contracted parcel or parcels or on other contracted lands in agricultural. <br /> preserves. The proposed use is for the farming and processing and of agricultural <br /> products on the contracted parcels. <br /> (3) The use will not result in the significant removal of adjacent contracted land from agricultural or <br /> open-space use.
