Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Mitigated Negative Declaration; and <br /> 2. Approve Use Permit application No. PA-1800037 with the Findings, Williamson Act Principles of <br /> Compatibility, and Conditions of Approval contained in the Staff Report. <br /> Findings <br /> 1) The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because truck terminal operations are consistent with the <br /> General Agriculture (A/G) General Plan designation and in turn may be conditionally <br /> permitted with a Use Permit application in the AG-160 (General Agriculture, 160-acre <br /> minimum) zone. The proposed olive processing operation and accessory wastewater <br /> storage ponds and storage reservoir are consistent with the goals, policies, standards <br /> and maps of the General Plan, and there are no Master Plans, Specific Plans, Special <br /> Purpose Plans, or any other applicable plan adopted by the County in the vicinity. <br /> 2) Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the proposed improvements related to the project <br /> are adequate. The project will be served by a private septic system, an individual well, <br /> and on-site storm drainage. <br /> 3) The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 870-acre property is of adequate size and shape <br /> to accommodate the proposed use. <br /> 4) Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or <br /> be injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for the project found no <br /> potentially significant environmental impacts with the incorporation of mitigation <br /> measures. With the inclusion of conditions of approval regarding landscaping along <br /> the freeway frontage, cultural resources, and participation in the San Joaquin Council <br /> of Governments San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan, the olive processing operation would not result in significant aesthetic, <br /> cultural, or biological impacts. In addition, submittal of a dust control plan to the San <br /> Joaquin Valley Air Pollution Control District will ensure that there is no significant <br /> impact to air quality. The project will also incorporate the recommendations identified <br /> in the Draft Geotechnical Design Report Musco Family Olive Company Plan New <br /> San Joaquin County PA-1800037/Musco Olive <br /> Community Development Page 6 <br />
