Tgrx Benjamin Hall - 3 - 30 November 2001 <br /> 1 January 2002, and the first monitoring report covering the Revised MRP is due by I March 2002. <br /> Please also note that the MRP requires continuous metering of flow,pH, and electrical conductivity by <br /> 1 February 2002. <br /> Enforcement <br /> As previously stated, Musco Olive Products is in serious violation of its WDRs and the C&A, and as a <br /> result Regional Board staff anticipate bringing an enforcement action before the Regional Board at its <br /> 25 January 2002 meeting. <br /> The action may consist of any or all of the following: a Cease-and Desist Order, an Administrative Civil <br /> Liability(a fine), or a California Water Code (CWC) Section 13308 Order. CWC Section 13308 allows <br /> the Board to impose a schedule for compliance and prescribe a civil penalty of up to $10,000 per day for <br /> failure to comply with the schedule. <br /> Technical Report <br /> Musco Olive shall make every effort to immediately comply with its WDRs and C&A. By <br /> 15 December 2001, Musco shall submit a report showing: a) the 401 Water Quality Certification has <br /> been filed with the,Regional Board (application enclosed), b) the Industrial Stormwater Permit <br /> application has been filed with the Regional Board, c) the changes made to comply with the"General <br /> Reporting Requirements" of the Standard Provisions, d) any changes made in operations as a result of <br /> this Notice of Violation, and e) the logic controls for the wastewater discharge system. <br /> We recognize that Musco Olive has submitted a Report of Waste Discharge (RWD)with the request to <br /> increase the flow of wastewater from 500,000 gal/day to 850,000 gal/day. At this time, it appears the <br /> request will not be processed, as Musco cannot currently manage its waste in compliance with the <br /> existing WDRs. <br /> If you have any questions about this letter or the revised MRP please contact Tim O'Brien at <br /> (916)255-3116.
