PLANNING COMMISSION MINUTES <br /> FEBRUARY 7, 1991 <br /> 5. MINOR SUBDIVISION APPLICATION N0, MS-91-20 OF RANCHETTES <br /> UNLIMITED: An appeal by Ranchettes Unlimited (c/o Charles Pringle) <br /> of Conditions of Approval for approved Minor Subdivision <br /> Application No. MS-91-20 to subdivide a 67-acre parcel into four <br /> 10-acre lots and one 27-acre remainder. Located 1070 feet west of <br /> Victory Road, 2000 feet south of Lone Tree Road, northeast of <br /> Escalon (Supervisorial District 5) . <br /> Associate Planner Chandler Martin introduced a staff report into <br /> the record. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Charles Pringle, 29409 Groomes Rd. , Oakdale, was <br /> present for this application. He said that Ranchettes Unlimited <br /> bought the property several months ago with the intent of selling <br /> off two parcels in order to get the funds to buy the Dutra dairy. <br /> He said that the Irrigation District should have discussed the <br /> problem with the plans at the time the right-of-way application was <br /> approved. They knew where the irrigation lines were at that time. <br /> He said he did not feel that the Irrigation District had the <br /> jurisdiction over this application. The irrigation system is very <br /> good at the present time. The ranch paid for a portion of the line <br /> in the 19601s. No traffic will go over the line. Curb, gutter and <br /> -- sidewalk should not be required along the road frontage. The <br /> General Plan states that this property will be AL-10 until the year <br /> 2010. Two additional homes will not cause a change in the <br /> character of the land. He objected to "paying $100, 000+ to ruin a <br /> good irrigation system. " <br /> OPPONENTS: David Moore, Engineer for the Oakdale Irrigation Dis- <br /> trict, , 548 Oakridge Dr. , Oakdale, said that the Oakdale Irri- <br /> gation District was not formed in 1908 when the tract was recorded. <br /> The irrigation ditch has to go on the contour and the pipeline was <br /> realigned prior to the Dutra ownership at the request of Mr. Rocha, <br /> who then owned the land. The conditions of the Oakdale Irrigation <br /> District are in conformance with Resolution 89-30, which is a <br /> policy of the Board of Directors. He said that if the County ever <br /> widens the road (an irrevocable offer of dedication was given for <br /> that widening) , that portion in the widened area will be over the <br /> pipeline. That is not an acceptable situation. The pipeline would <br /> have to be upgraded at that time. It is the policy of the Board to <br /> avoid such problems. <br /> REBUTTAL: Mr. Pringle said the irrigation line is out of the right <br /> of way and no vehicles will go over it. He said he did not think <br /> the County would ever widen the road. <br /> PUBLIC HEARING CLOSED <br /> Comm. Gillispie said that a "cast-in-place pipe" cannot take <br /> -3- <br />
