The project site is located on the south side of Thalheim Colony Tract Road, 1950 feet <br /> west of South Victory Road, northeast of Escalon. The surrounding land uses include <br /> single family residences, detached accessory buildings, and agricultural operations. <br /> The Community Development Department has reviewed the proposed Revisions of <br /> Approved Actions Application and offers the following comments: <br /> Department of Public Works <br /> The Department of Public Works submitted a letter dated March 23, 2007 <br /> recommending denial of the Revision of Approved Actions application. The Department <br /> of Public Works is concerned that the applicant's requests are not consistent with the <br /> Development Title requirements. Specifically, Development Title Section 9-1150.15 (d) <br /> states "a maximum of six (6) existing and/or potential lots may be served by the private <br /> right-of-way or the private right-of-way shall be improved to San Joaquin County <br /> Improvement Standards for public roads". Additionally, Development Title Section 9- <br /> 1150.15 (e) states "if it is found in the review of the tentative map that in the future it may <br /> be necessary to include the right-of-way in the County's road system, the applicant shall <br /> make an irrevocable offer of dedication of the right-of-way to the County and execute a <br /> Deferred Frontage and Roadway Improvement Agreement". Thalheim Colony Tract <br /> road must be dedicated and improved to County Standards as the road is part of an <br /> antiquated subdivision and has the potential to be in the County's road system and <br /> exceeds the six-lot maximum standard for permitting access via a private right-of-way <br /> (Development Title Section 9-1150.15(d)). The applicant must demonstrate control of <br /> title over the land necessary to make these road improvements. <br /> The project has been tentatively scheduled for the Planning Commission meeting on <br /> June 6, 2007.
