The project site is located on the south side of Thalheim Colony Tract Road, 1950 feet
west of South Victory Road, northeast of Escalon. The surrounding land uses include
single family residences, detached accessory buildings, and agricultural operations.
The Community Development Department has reviewed the proposed Revisions of
Approved Actions Application and offers the following comments:
Department of Public Works
The Department of Public Works submitted a letter dated March 23, 2007
recommending denial of the Revision of Approved Actions application. The Department
of Public Works is concerned that the applicant's requests are not consistent with the
Development Title requirements. Specifically, Development Title Section 9-1150.15 (d)
states "a maximum of six (6) existing and/or potential lots may be served by the private
right-of-way or the private right-of-way shall be improved to San Joaquin County
Improvement Standards for public roads". Additionally, Development Title Section 9-
1150.15 (e) states "if it is found in the review of the tentative map that in the future it may
be necessary to include the right-of-way in the County's road system, the applicant shall
make an irrevocable offer of dedication of the right-of-way to the County and execute a
Deferred Frontage and Roadway Improvement Agreement". Thalheim Colony Tract
road must be dedicated and improved to County Standards as the road is part of an
antiquated subdivision and has the potential to be in the County's road system and
exceeds the six-lot maximum standard for permitting access via a private right-of-way
(Development Title Section 9-1150.15(d)). The applicant must demonstrate control of
title over the land necessary to make these road improvements.
The project has been tentatively scheduled for the Planning Commission meeting on
June 6, 2007. The Community Development Department has reviewed the Revisions of
Approved Actions application and, based upon the Department of Public Works'
recommendation of denial of the application, the Community Development Department
will, also, recommend denial.
MH:vb
PA-050082 9(MS)M H DC05162007
Attachments
C: Patricia E.
