Victory Road APN: 229-220-30 <br /> INFORMATION: <br /> The Department is concerned that the requested revisions are for conditions which are Ordinance requirements <br /> for which relief is not allowable from the applicable provisions of the San Joaquin County Development Title. <br /> REMARKS: <br /> If the proposed Revision of Approved Actions Application was to continue in the application process, the <br /> Department of Public Works would recommend denial for the following reasons: <br /> 1. APPEAL STATEMENT: Remove Public Works' Condition of Approval,Requirement No. 1, <br /> that requires the applicant to acquire or submit evidence of the ability to acquire title for <br /> dedication of a portion of Thalheim Colony Tract Road extending from the eastern edge of the <br /> project property out to Victory Road, <br /> RESPONSE: The applicant is proposing to create new lots with access to a County-maintained <br /> requires roadway via Thalheim colony Tract Road, a private access road. The Development Title <br /> (Section 9-1150.15)requires the access road to be developed to full County standards. I <br /> Therefore, the right-of-way on the project's side of the roadway must also be widened an ; <br /> additional five (5) feet to accommodate the improved road. The applicant is being required to <br /> demonstrate control of title over the land necessary for the required roadway widening to ensure <br /> the ability to comply with all provisions of the San Joaquin County Development Title with <br /> respect to the proposed development application. <br />
