CONDITIONS OF APPROVAL <br /> MS-94-19 <br /> Payne <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin) <br /> a. The 78-acre Parcel 1 shall be redesignated as the remainder. <br /> b. Parcel 1 (the 5-acre homesite) shall have a minimum width of 150 feet. (Development <br /> Title Section 9-610.4) <br /> C. Parcel 1 shall be between two net acres and five gross acres in size. (Development Title <br /> Section 9-610.3(a]) <br /> d. Village Drive shall be improved from the west end of the remainder to the east end of <br /> Parcel 1, as required by General Note 16 of the parcel map of Camanche Rancheros <br /> (Book 11, Page 158). <br /> e. The homesite and remainder parcels shall have a Notice of Minor Subdivision Restriction <br /> recorded by separate instrument concurrently with the map to indicate the following <br /> restrictions: <br /> (1) Neither the homesite parcel (Parcel 1) nor the remainder parcel may be <br /> voluntarily transferred separately from the other parcel. However, if an <br /> institutional lender forecloses on either parcel, either parcel may be transferred <br /> separately in accordance with the power of sale provisions contained in the deed <br /> of trust. <br /> (2) Upon repayment of the loan, the owner of the homesite parcel shall merge the <br /> homesite parcel with the remainder parcel, as provided for in the Development <br /> Title, unless the owner of the homesite parcel acquired the homesite parcel <br /> through a foreclosure action or unless the owner refinances the loan. <br /> (3) The remainder parcel shall remain a nonbuildable site for primary dwelling units. <br /> However, if either parcel is transferred separately as provided in paragraph (1) <br /> above, the nonbuildable restriction shall be removed subject to the following <br /> condition: <br /> Conditions of Approval 1 - MS-94-19 <br />
