A subsequent field check and investigation by staff indicated that (1) recreational vehicles and boats were <br /> still being used as living quarters with connection to water and electricity, (2) permits had still not been <br /> secured for the mobile office, (3) outside repair work on boats was still being done, (4) the Improvement <br /> Plan had not been completed, and (5) a Business License had not yet been submitted. <br /> Revocation Procedures <br /> Chapter 9-230 of the Development Title states that the Planning Commission may revoke or modify a <br /> development application upon making any one or more of the three following Findings: <br /> 1. Fraud: That such development approval was obtained or extended by fraud; <br /> 2. Violation of Condition: That one or more of the conditions upon which such development <br /> approval was granted have been violated; or <br /> 3. Adverse Impacts: That the use or facility for which the development approval was granted is so <br /> conducted or maintained as to be detrimental to the public health or safety, or as to be a public <br /> nuisance. <br /> Based upon the ability to make the second and third grounds for revocation or modification,the 27-month- <br /> long period of non-compliance, and the repeated failure on the part of the owner of the property and <br /> operator of the business to fulfill the Conditions of Approval, staff is recommending to the Planning <br /> Commission that the Use Permit application be revoked, rather than modified. <br /> San Joaquin County U-78-9/Hunt <br /> Community Development Page 4 <br />
