Recommendations <br /> Action <br /> It is recommended that the Planning Commission revoke Use Permit Application No. U-78-9 based <br /> on the Finding that the second and third of the three grounds for revocation or modification can be <br /> made In the affirmative. <br /> Grounds for Revocation or Modification <br /> 1. Fraud: That such development approval was obtained or extended by fraud. <br /> The grounds for the fraudulent establishment of the Use Permit cannot be made, because no <br /> such information or evidence has been submitted. <br /> 2. Violation of Condition: That one or more of the conditions upon which such development <br /> approval was granted have been violated. <br /> The grounds for violation of conditions can be made because: boats are being used for <br /> residences, the mobile office has no permits, outside repair work Is taking place, the <br /> Improvement Plan has not been completed, and the Business License has not been <br /> submitted. <br /> 3. Adverse Impacts: That the use or facility for which the development approval was granted is so <br /> conducted or maintained as to be detrimental to the public health or safety, or as to be a public <br /> nuisance. <br /> The grounds for adverse impacts can be made because occupancy of boats and recreational <br /> vehicles without proper water, sewage disposal, and electrical services represents a public <br /> health hazard. <br /> San Joaquin County U-78-9/Hunt <br /> Community Development Page 5 <br />
