Analysis <br /> Background <br /> The previous business that occupied the site of the proposed sports bar was a hair salon. The business <br /> currently occupying the eastern end of the building is a pizza restaurant. The parcel is located within the <br /> urban community of Woodbridge. <br /> Change in Circumstance <br /> In the application for the Revisions of Approved Actions, the applicant states that the change in <br /> circumstances involves financial issues and the existence of services and improvements. The applicant <br /> states that if he is required to pay to obtain public water service, and to pay the undetermined Area of <br /> Benefit fees, this would be financially prohibitive to the project. Also, the applicant states that there is an <br /> existing well, drainage system and sidewalk on-site. <br /> Department of Public Works <br /> The Department of Public Works is recommending denial of the proposed revisions for the following <br /> reasons: <br /> Condition #2 <br /> "Frontage improvements which provide for drainage and a sidewalk for pedestrians shall be constructed <br /> along Augusta Street across the subject Parcel prior to issuance of the occupancy permit. (Development <br /> Title Section 9-1150.2)" <br /> • The orderly development of the area necessitates that improvements to drainage and <br /> streets be incorporated as projects move forward. In addition, San Joaquin County <br /> Development Title Section 9-1150.2(d)(1) requires development projects that generate 50 <br /> or more vehicles per day to provide frontage improvements. The Institute of <br /> Transportation Engineers defines the use type for a sports bar as "Drinking Place." Based <br /> upon the square footage of the proposed use, it was determined from information <br /> obtained from the Institute of Transportation Engineers that,for the Drinking Place use <br /> type, there would be 230 vehicle trips per day. <br /> Condition #7 <br /> "The project shall be served by a public water system conforming to the requirements of the San Joaquin <br /> County Public Health-Services Environmental Services Division and the Department of Public Works <br /> The Services shall be provided by Mokelumne Acres Maintenance District " <br /> • San Joaquin County Development Title Section 9-1120.2(i) states "Development projects <br /> using existing structures and adding no new structures shall be served by a public water <br /> system if there is an existing water main within two hundred (200) feet of the nearest <br /> property line." This project is using an existing structure. There are water mains on <br /> Augusta Street and on Lower Sacramento Road, both within 200 feet. Therefore, the <br /> regulations require that the project be served by the water system.
