Based on this review, we offer the following comments. <br /> SLC Jurisdiction <br /> The State acquired sovereign ownership of all tidelands and submerged lands and beds of <br /> navigable waterways upon its admission to the United States in 1850. The State holds these lands for the <br /> benefit of all the people of the State for statewide Public Trust purposes which include waterborne <br /> commerce, navigation, fisheries, water-related recreation, habitat preservation, and open space. The <br /> landward boundaries of the State's sovereign interests are generally based upon the ordinary high water <br /> marks of these waterways as they last naturally existed. Thus, such boundaries may not be readily <br /> apparent from present day site inspections. The State's sovereign interests are under the jurisdiction of the <br /> State Lands Commission. <br /> It appears from the information provided that the proposed project involves Whiskey Slough and <br /> Middle River which are sovereign lands of the State of California. However, staff of the Commission <br /> would need a more precise description of the project to determine the extent to which it involves these <br /> waterways. Any improvements involving these waterways would be subject to the leasing requirements <br /> of the Commission. Therefore, please contact Diane Jones, (916) 574-1843, for information about our <br /> leasing requirements. <br /> Environmental Comments <br /> As a Responsible and Trustee Agency under CEQA for the proposed project, we are concerned <br /> with the scope and content of the Negative Declaration. The document should include a more detailed <br /> description of the existing facilities including dimensions and the exact location of the proposed project. <br /> The project description should also discuss what access presently exists from the waterway to the duck <br /> club on the island interior. <br />
