1 <br /> Standard for Storage of Rubber Tires" , National Fire Protection <br /> 2 <br /> Association, NFPA 231D-1989 edition; and <br /> 3 <br /> WHEREAS the CIWMB has the authority to order WTF operators <br /> 4 <br /> who are in violation of the aforementioned regulations, to clean <br /> 5 <br /> up waste tire piles, abate the effects thereof, or otherwise <br /> 6 <br /> remediate a case of threatened pollution or nuisance pursuant to <br /> 7 <br /> PRC, section 42845 (a) ; and <br /> a <br /> WHEREAS the CIWMB has the authority to seek civil penalties <br /> 9 <br /> of not less that five hundred dollars ($500) and up to ten <br /> 10 <br /> thousand dollars ($10 , 000) for each violation of a separate <br /> 11 <br /> provision or, for continuing violations, for each day that <br /> 12 <br /> violation continues, against any person who violates any provision <br /> 13 <br /> of this chapter, or any permit, rule, regulation, standard, or <br /> 14 <br /> requirement issued or adopted pursuant to this chapter as provided <br /> 15 <br /> in PRC sections 42850 and 42850 . 1 (b) (2) ; <br /> 16 <br /> THEREFORE, PURSUANT TO PRC SECTION 42845, YOU ARE ORDERED TO: <br /> 17 <br /> 1 . Cease acceptance of any waste tires at this WTF until <br /> 18 <br /> such time that a permit has been obtained or this WTF no longer. <br /> 19 <br /> meets the minor WTF definition. <br /> 20 - <br /> 2 . Remove all waste tires from the premises by July 30, <br /> 21 <br /> 1999 in accordance with the following waste tire removal schedule <br /> 22 <br /> and operation plan. <br /> 23 <br /> A. Waste Tire Removal Schedule <br /> 24 <br /> (1) Waste tires shall be removed from the premises . <br /> 25 <br /> The CIWMB must approve the destinations of the tires to <br /> 26 <br /> ensure that they are legally transported to an approved <br /> 27 <br /> facility. <br /> 3 . <br />
