THE MATERIAL IS IMPACTING SOIL, NO WATERWAYS. CALLER STATES THAT MULTIPLE POWER <br /> COMPANIES ARRIVED ON SCENE AND NO ONE CLAIMED OWNERSHIP OF THE PIPE. REPORTING PARTY HAS <br /> CONTACTED A CONTRACTOR FOR CLEANUP OF THE MATERIAL. SPILL OCCURRED AT APPROXIMATELY 11:30 <br /> AM 9/6/19. <br /> OBSERVATIONS: <br /> Observed and smelled what appeared to be standing diesel fuel at the bottom of a trench, approximately 7 feet in depth. <br /> The diesel appeared to have come out of the steel pipe at the bottom of the trench,which contained the auger drill used by <br /> WBCM Construction Services to install a liquid fertilizer pipe, on behalf of Yara North America.WBCM marked the location <br /> on the ground in which they state the drill struck what they think may be an abandoned fuel line,—7 feet beneath the ground. <br /> The distance from the WBCM mark on the ground to the location of the observed fuel in the trench is 65-80 feet long. <br /> WBCM has contracted Ancon Services to conduct an excavation to reveal the source of the release, using"hydro <br /> excavation."Ancon is scheduled to begin excavation on Monday, 9/9/2019 at 9 AM, however the SJC EHD has informed <br /> WBCM,Yara North America, and Ancon that the EHD is will reach out to the State Waterboard to verify if the scheduled <br /> excavation is acceptable given theincident's surrounding environment. <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br /> (a)]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br /> procedure[HSC 25160(b)(3)]. Provide a waste/hazardous waste disposal records to the EHD for all clean up debris <br /> associated with this spill clean up. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> • Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> kORRECTIVE ACTIONS/ORDER: <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
