California Tank Lines, Inc. <br />October 19, 2016 <br />Page 2 <br />Corrective action: Cal Tank Lines must immediately clean releases found in the <br />secondary containment and log the spills including cleanup activities in the daily tank <br />inspection logs. In addition Cal Tank Lines must make a determination if the spills are <br />hazardous waste using generator's knowledge or with an analytical method, i.e. test the <br />waste. Thereafter, Cal Tank Lines must properly manage and dispose of the any <br />hazardous in accordance with Hazardous Waste Control Laws. Within 15 days of <br />receipt of this SOV, Cal Tank Lines must submit detail plans to DTSC that describes <br />the corrective action(s) taken or planned, including but not limited to training facility <br />personnel, to (1) cleanup spills in a timely and safe manner, (2) how to conduct <br />inspections, (3) how to complete the log including the findings of any spill events and <br />(4) any additional steps necessary in order to prevent the reoccurrence of this violation <br />in the future. <br />Violation #2 <br />On or about September 29, 2016 Cal Tank Lines violated California Health and Safety <br />Code Sections 25201 and 25200.3 in that the facility conducted unauthorized treatment <br />of several waste streams that contained bases or base over 10 percent by weight, or <br />that have multiple characteristics such as, but not limited to Hydroflurosalicic Acid <br />(HFS), which has the characteristics of a corrosiveness and toxicity. During the <br />inspection the facility had conditional authorization for elemental neutralization but did <br />not have Permit by Rule (PBR) authorization which is required for waste streams with <br />multiple waste characteristics. <br />Corrective action: Cal Tank Lines must immediately cease the unauthorized treatment <br />activities and follow the requirements for conditionally authorized facility or obtain <br />authorization for the PBR tier. Within 15 days of receipt of this SOV, Cal Tank Lines <br />must submit detail plans to DTSC that describes the corrective action(s) taken or <br />planned, including but not limited to training facility personnel, to prevent the <br />reoccurrence of this violation in the future <br />Violation #3 <br />On or about September 29, 2016 Cal Tank Lines violated California Health and Safety <br />Code Section 25200.3 (c) (3) in that it does not comply with the environmental <br />assessment procedures required for the facility to ensure if there is contamination <br />resulting from the release of hazardous waste or constituents from a solid waste <br />management unit or a hazardous waste management unit at the generator's facility, <br />regardless of the time at which the waste was released. <br />
