Inspection Date: September 29, 2016 <br />ENVIRONMENTAL P -ALi <br />DTSC's response: Cal Tank Line has not submitted 'th'e training curriculum and training records <br />of the facility personnel regarding best management practice of hazardous waste, as described <br />in corrective action by DTSC . Thus, the violation will be complied when Cal Tank Lines <br />completes the training and submits the training curriculum, and the training records to DTSC. <br />Violation #2 <br />On or about September 29, 2016 Cal Tank Lines violated California Health and Safety Code <br />Sections 25201 and 25200.3 in that the facility conducted unauthorized treatment of several <br />waste streams that contained bases or base over 10 percent by weight, or that have multiple <br />characteristics such as, but not limited to Hydroflurosalicic Acid (HFS), which has the <br />characteristics of a corrosiveness and toxicity. During the inspection the facility had conditional <br />authorization for elemental neutralization but did not have Permit by Rule (PBR) authorization <br />which is required for waste streams with multiple waste characteristics. <br />Corrective action: Cal Tank Lines must immediately cease the unauthorized treatment <br />activities and follow the requirements for conditionally authorized facility or obtain <br />authorization for the PBR tier. Within 15 days of receipt of this SOV, Cal Tank Lines must <br />submit detail plans to DTSC that describes the corrective action(s) taken or planned, including <br />but not limited to training facility personnel, to prevent the reoccurrence of this violation in the <br />future <br />Response from Cal Tank Lines: In the letter dated October 31, 2016, sent to DTSC vial email, Cal <br />Tank Line described that "we are working with the Environmental Health Department to <br />upgrade our Permit to a PBR". Cal Tank Lines submitted PBR application to CUPA on October <br />31, 2016, which was approved on November 7, 2016. <br />DTSC's response: No additional compliance is needed for this item. <br />Violation #3 <br />On or about September 29, 2016 Cal Tank Lines violated California Health and Safety Code <br />Section 25200.3 (c) (3) in that it does not comply with the environmental assessment <br />procedures required for the facility to ensure if there is contamination resulting from the <br />release of hazardous waste or constituents from a solid waste management unit or a hazardous <br />waste management unit at the generator's facility, regardless of the time at which the waste <br />was released. <br />Corrective action: Cal Tank Lines must immediately comply with the requirements for the <br />conditional authorized facility and/or hazardous waste generator. Within 30 days of receipt of <br />this SOV, Cal Tank Line must submit the evidence, environmental phase I assessment, and the <br />detailed plans to DTSC that describes that action(s) taken or planned, including but not limited <br />to training facility personnel, to prevent the reoccurrence of this violation. <br />30 <br />
