Issued on Behalf of the California Integrated Waste Management Board sltgc ui Ci lilol111a r. cif♦ ur NOTICE OF VIOLATION �,i 184(0404) This Notice of Violation (NOV) constitutes formal and legal notice that one or more violations of the Public Resources Code (PRC) and/or Title 14, California Code of Regulations (14 CCR), occurred and was documented in the attached Waste Tire Survey & Inspection Report (Inspection Report). Please refer to the Inspection Report to find the specific violation(s) cited. Copies of the California Used and Waste Tire Hauling and Storage laws and regulations are attached and can be referenced for an expanded explanation of the violation(s) cited. The NOV is the first step in the waste tire enforcement process. When violations are discovered, the inspector issues the NOV and assigns a Compliance Deadline Date (CDD). (See the Enforcement Status box on page one of the Inspection Report.) The CDD is the responsible party's deadline to correct the violation(s). A re-inspection will be conducted within 30 days of the CDD. If that inspection reveals continued noncompliance, further enforcement actions may be taken. Further enforcement actions may include, but are not limited to: (1) issuing Enforcement Orders, (2) filing Administrative Complaints seeking Administrative Penalties up to $25,000 for each violation [PRC §42962(a)], (3) filing Criminal Complaints and seeking penalties, and/or (4) seeking revocation of Tire Hauler Registrations and/or Waste Tire Facility Permits. As a business operator, owner, and/or property owner (for tire storage facilities), you are responsible for complying with the Used and Waste Tire Hauling and Manifesting Requirements as well as the Waste Tire Storage and Disposal Standards. As a recipient of this notice, you are responsible for correcting the violation(s) by the CDD noted on the Inspection Report. For your convenience, further information regarding the Waste Tire Enforcement Process as well as used and Waste Tire Hauler and Manifest Information has been included on the back of this notice.
