California Integrated Waste Management Board <br /> Waste Tire Enforcement Process <br /> Step 1 <br /> Notice of Violation (NOW During an inspection, authorized by Public Resources Code <br /> §43303, if a violation is cited a NOV is issued. The NOV is the formal and legal notice <br /> that informs the business operator, owner, and/or property owner that they are in <br /> violation of the Waste Tire Storage and/or Used and Waste Tire Hauling & Manifesting <br /> Laws and Regulations, and of the possible consequences of not correcting the <br /> violation(s). The inspection report and copies of the pertinent laws and regulations are <br /> handed out with the NOV to the business representative on the day of inspection and/or <br /> mailed to the business operator, owner, and/or property owner. The inspection report <br /> contains the Compliance Deadline Date (CDD), the date the violations cited are to be <br /> corrected. <br /> Step 2 <br /> Enforcement Order: Within 30 days after the CDD, the inspector will re-inspect the <br /> facility or operation to determine the status of the violation(s). For Tire Storage <br /> Violation(s): If the violations have not been corrected, orders to Clean up and Abate or <br /> Cease and Desist are issued. For Hauler or Manifesting Violations: If the violation has <br /> not been corrected the inspector may go directly to STEP 3 in the enforcement process. <br /> Step 3 <br /> Administrative Complaint(AC): An AC may be filed with an Administrative Law <br /> Judge seeking penalties if the hauling/manifesting violations persist or if the responsible <br /> party or property owner and/or operator fail to comply with an issued order or multiple <br /> warnings. <br /> Hauling/manifesting Information: Anyone transporting 10 or more waste or used tires <br /> on a public road must be a CIWMB Registered Waste Tire Hauler(or exempt) and <br /> comply with the manifesting system requirements. For further information on how to <br /> become a registered hauler, obtain a list of registered haulers, or information on the <br /> waste tire manifest system, contact the California Integrated Waste Management Board <br /> (CIWMB) using the toll free number(866) 896-0600 or visit the CIWMB's tire web <br /> page at http://www.ciwmb.ca.gov/Tires/. <br /> Tire Storage Information: The storage, stockpiling, or accumulation of 500 or more <br /> waste tires without a permit, exclusion, or an exemption is a violation of Title 14, <br /> California Code of Regulations, section 18420 and Public Resources Code, section <br /> 42834.
