5.1 AIR QUALITY <br /> Purpose:Requires the issuance of operating permits that identify all applicable federal <br /> performance,operating,monitoring,recordkeeping, and reporting requirements. Title V <br /> applies to major facilities,Phase II acid rain facilities, subject solid waste incinerator facilities, <br /> and any facility listed by EPA as requiring a Title V permit. These requirements are <br /> implemented at the local level with federal oversight. <br /> Administering Agency:SJVAPCD,with EPA Region 9 oversight. <br /> 5.1.6.2 State LORS <br /> The CARB was created in 1968 by the Mulford-Carrell Air Resources Act,through the merger <br /> of two other state agencies. The CARB's primary responsibilities are to develop, adopt, <br /> implement,and enforce the state's motor vehicle pollution control program;to administer <br /> and coordinate the state's air pollution research program;to adopt and update, as necessary, <br /> the state's ambient air quality standards;to review the operations of the local air pollution <br /> control districts; and to review and coordinate preparation of the SIP for achievement of the <br /> federal ambient air quality standards. The CARB has implemented the following state or <br /> federal stationary source regulatory programs in accordance with the requirements of the <br /> federal Clean Air Act and California H&SC: <br /> • State Implementation Plan <br /> • California Clean Air Act <br /> • Toxic Air Contaminant Program <br /> • Nuisance Regulation <br /> • Air Toxics"Hot Spots' Act <br /> • CEC and CARB Memorandum of Understanding <br /> • California Climate Change Regulatory Program <br /> State Implementation Plan <br /> Authority:H&SC §39500 et seq. <br /> Purpose:Required by the federal Clean Air Act,the SIP must demonstrate the means by <br /> which all areas of the state will attain and maintain NAAQS within the federally mandated <br /> deadlines. The CARB reviews and coordinates preparation of the SIP. Local districts must <br /> adopt new rules (and/or revise existing rules) and demonstrate that the resulting emission <br /> reductions,in conjunction with reductions in mobile source emissions,will result in the <br /> attainment of NAAQS. The relevant SJVAPCD Rules and Regulations that have also been <br /> incorporated into the SIP are discussed with the local LORS. <br /> Administering Agency:SJVAPCD,with CARB and EPA Region 9 oversight. <br /> California Clean Air Act <br /> Authority:H&SC§40910—40930 <br /> Purpose:Established in 1989, the California Clean Air Act requires local districts to attain <br /> and maintain both national and state ambient air quality standards at the"earliest practicable <br /> date." Local districts must prepare air quality plans demonstrating the means by which the <br /> ambient air quality standards will be attained and maintained.
