5.1 AIR QUALITY <br /> Purpose:Establishes requirements in the CEO's decision-making process for an AFC that <br /> assures protection of environmental quality. The AFC is required to include information <br /> concerning air quality protection. <br /> Administering Agency: CEC. <br /> California Climate Change Regulatory Program <br /> Authority:Stats. 2006, Ch.488 and CA Health&Safety Code§38500-38599 <br /> Purpose:The State of California adopted the Global Warming Solutions Act of 2006 <br /> (Assembly Bill [AB] 32) on September 27,2006,which requires sources within the state to <br /> reduce carbon emissions by approximately 25% by the year 2020. The California Climate <br /> Action Registry had already published protocols for voluntary reporting of GHG emissions <br /> from a number of sectors of the economy,21 and the CARB has proposed draft regulations to <br /> limit GHG emissions from electric power plants and other specific source categories.22 In <br /> addition,the CARB has issued draft guidance with recommended emission factors for <br /> calculating GHG emissions.23 <br /> AB 32 also sets the following milestone dates for the CARB to take specific actions: <br /> June 30,2007: Identify a list of discrete early action GHG emission reduction measures (first <br /> report published April 2O,2007,with additional measures adopted on October 25,2007). <br /> January 1,2008: Establish a statewide GHG emission cap for 2020 that is equivalent to 1990 <br /> emissions. <br /> January 1,2008: Adopt mandatory reporting rules for significant sources of GHGs. <br /> January 1,2009: Adopt a scoping plan that will indicate how GHG emission reductions will <br /> be achieved from significant GHG sources through regulations,market-based compliance <br /> mechanisms,and other actions,including recommendation of a de minimis threshold for <br /> GHG emissions,below which sources would be exempt from reduction requirements. <br /> January 1,2011: Adopt regulations to achieve maximum technologically feasible and cost- <br /> effective GHG emission reductions,including provisions for both market-based and <br /> alternative compliance mechanisms. <br /> January 1,2012: Regulations adopted prior to January 1,2010,become effective. <br /> Senate Bill (SB) 97,adopted August 21,2007,requires the California Office of Planning and <br /> Research (OPR) to develop CEQA guidelines "for the mitigation of GHG emissions or the <br /> effects of GHG emissions" by July 1,2009. SB 97 further requires the Resources Agency <br /> Secretary to adopt these CEQA guidelines by January 1,2010.
