I insofar as they are doing business in the State of California and confined to Defendant's <br /> 2 RESTAURANT activities in the County of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant,with actual or constructive knowledge of this Injunction,only in so far as they <br /> 4 are doing business in the State of California,in the course of Defendant's RESTAURANT activities, <br /> 5 are pursuant to Health and Safety Code section 25515.6 hereby permanently enjoined from: <br /> 6 a. Failing to complete and/or submit a site map,in violation of Health and Safety <br /> 7 Code section 25505(a)(2); <br /> 8 b. Failing to submit emergency response plans and procedures for a release or <br /> 9 threatened release of a hazardous material, in violation of Health and Safety Code section <br /> 10 25505(a)(3); <br /> 11 c. Failing to provide training for all new employees and annual training, including <br /> 12 refresher courses, for all employees in safety procedures in the event of a release or threatened <br /> 13 release of hazardous material,in violation of Health and Safety Code section 25505(a)(4); <br /> 14 d. Failing to document training electronically or by hard copy and retain for a <br /> 15 minimum of three(3)years,in violation of Health and Safety Code section 25505(a)(4); <br /> 16 e. Failing to have emergency response plan and procedures,the inventory of <br /> 17 hazardous material and the site map readily available to personnel of the business or the unified <br /> 18 program agency,in violation of Health and Safety Code section 25505(c); <br /> 19 f. Failing to complete and/or submit a hazardous materials inventory for all reportable <br /> 20 materials on site, in violation of Health and Safety Code section 25506(a); <br /> 21 g. Failing to establish and implement a business plan for emergency response to a <br /> 22 release or threatened release of hazardous material, in violation of Health and Safety Code section <br /> 23 25507(a); <br /> 24 h. Failing to electronically submit a hazardous materials business plan annually to the <br /> 25 statewide information management system,in violation of Health and Safety Code section <br /> 26 25508(a)(1)(A); and <br /> 27 i.Failing to review and certify,on or before the annual due date,that the statewide <br /> 28 information management system is complete, accurate,and in compliance,in violation of Health and <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
