CLEANUP AND ABATEMENT ORDER NO. -3- <br /> FOR DALLAS CORP. , DBA OVERHEAD/LODI DOOR COMPANY <br /> LODI , SAN JOAQUIN COUNTY <br /> toxic than trivalent chromium. Sample results have shown that up to 100 <br /> percent of the total chromium in the samples is hexavalent. <br /> 16. The Discharger alleges that further monitoring does not serve any purpose <br /> and that concentrations do not warrant ground water cleanup. After <br /> accumulating six years of data, the Discharger has made several requests to <br /> discontinue ground water monitoring and destroy the monitoring wells. <br /> 17. Wells downgradient from the former surface impoundment have chromium �, <br /> concentrations above the MCL and the extent of the plume has not been [D: <br /> defined. <br /> 18. There are at least ten wells for domestic purposes within a 1/2 mile radius <br /> of the facility. Of these, six are generally downgradient of the <br /> Discharger. <br /> D <br /> 19. Staff collected a water sample from a domestic well within one-half mile <br /> downgradient of the facility on 26 February 1991. The sample contained <br /> 1 µg/l total chromium. The depth of the well and screen interval is <br /> unknown. <br /> 20. Section 13304(a) of the California Water Code provides that "Any person who <br /> has discharged or discharges into the waters of this state in violation of <br /> any waste discharge requirement or other order or prohibition issued by a <br /> regional board, or who has caused or permitted, causes or permits, or <br /> threatens to cause or permit any waste to be discharge or deposited where <br /> it is, or probably will be, discharged into the waters of the state and <br /> creates, or threatens to create, a condition of pollution or nuisance, C <br /> shall upon order of the regional board cleanup such waste or abate the <br /> effects thereof or, in the case of threatened pollution or nuisance, take <br /> other necessary remedial action. " <br /> 21. In conducting an investigation of the quality of any waters of the state <br /> within its region, the regional board may require that any person <br /> discharging or proposing to discharge waste within its region or any <br /> citizen or domiciliary, or political agency or entity of this state <br /> discharging or proposing to discharge waste outside its region that could <br /> affect the quality of waters within its region shall furnish, under penalty <br /> of perjury, those technical or monitoring program reports as the board may <br /> specify. The burden, including costs, of those reports shall bear a <br /> reasonable relationship to the need for the report and the benefits to be <br /> obtained from the reports. (Water Code, Section 13267) <br /> 22. Issuance of this Order is exempt from the provisions of the California <br /> Environmental Quality Act (Public Resources Code, Section 21000, et seq. ) , <br /> in accordance with Section 15321(a) (2) , Title 14, California Code of <br /> Regulations. <br />
