Analysis <br /> Background <br /> On August 3, 2017, the Planning Commission reviewed the original draft of the proposed Development Title <br /> Text Amendment application regarding electrified security fencing. The Planning Commission stated <br /> concerns regarding safety, incompatibility with non-industrial zones, and incompatibility with adjoining land <br /> uses. Ultimately, the Planning Commission determined the proposed Text Amendment application was <br /> inconsistent with the General Plan and voted 4-1 to deny the application. <br /> On September 27, 2017, the Board of Supervisors heard the Text Amendment application on appeal. After <br /> considering all written and oral testimony, the Board stayed the appeal and directed the applicant to work <br /> with the Community Development Department on a revised Text Amendment application description. <br /> Community Development Department staff met with the applicant on multiple occasions. However, because <br /> there was no consensus between the applicant and the Community Development Department, the item <br /> was returned-to the Board of Supervisors on June 5, 2018.The Community Development Department again <br /> recommended deni-al, stating that the concerns-of. the Planning Commission had not yet been addressed. <br /> The Board of Supervisors voted to refer the revised text back to the Planning Commission for review. <br /> The applicant has continued toworkwith the Community Development Department, and the proposed text <br /> for review is the result of these continued meetings. <br /> Existing_Ordinance <br /> The Development Title permits electrified fencing in the industrial zones. The intent of the Fencing and <br /> Screening Chapter is to prescribe standards for fencing and screening to protect public security and safety, <br /> and conserve and protect property.As a result,-Development Title Section 9-1022.3(e)provides restrictions <br /> on the placement of electrified fencing near residential areas stating"electrical fencing adjacent to planned <br /> or existing residential areas is prohibited."Therefore, electrified fencing is not permitted adjacent to parcels <br /> with a General Plan designation of residential, a zoning of residential, or that are developed with an existing <br /> residence. <br /> Currently the Development Title remains-silent regarding electrified fencing in the commercial, agricultural, <br /> and residential zones. San Joaquin County Development Title is a permissive zoning document in which <br /> uses are prohibited unless they are-expressly permitted through an ordinance. As a result, electrified <br /> fencing is not currently permitted 'inthe agricultural, commercial zones,or residential zones. <br /> However, pursuant to Development Title Section 9-1022.6, the fencing requirements of the Development <br /> Title can be modified by the Director in cases where it is demonstrated that an alternative to said <br /> requirements would meet the intent of the Chapter. The applicant has previously submitted modification <br /> requests pursuant to Development Title Section 9-1022.6. The Community Development Department has <br /> reviewed each request on a case-by-case basis to determine if the intent of the Development Title has been <br /> met through each modification.As a result, the Community Development Department was able to approve <br /> many of these requests because the electrified fences were to be located in areas that were predominantly <br /> industrial. <br /> San Joaquin County PA-17000841Electric Guard Dog, LLC <br /> Community Development Page 3 <br />
