Previously Approved Conditions <br /> Quarry Excavation Application No. QX-91-0006 was approved by the Planning Commission on <br /> The effective date of approval is . This approval will expire on ,which is 18 months from <br /> the date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary <br /> building permits have been secured and remain in force, and (3) all necessary permits from other <br /> agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified; and, other ordinance requirements may <br /> apply. <br /> 1. DEVELOPMENT SERVICES DIVISION: <br /> Conditions of Approval: <br /> a. This permit shall expire DOGember 31, 2018 December 31, 2036. All proposed excavation <br /> and rehabilitation shall be completed prior to the expiration of this permit in accordance <br /> with the application and reclamation plan. <br /> b. Plant operations shall not be carried on during the hours of 9:00 p.m. to 5:00 a.m- except <br /> during periods of declared national, stated or county emergency(Section 9-2244 (f)). <br /> C. _A 100-foot set back is required from the natural swale and wetlands area. <br /> d. A 50-foot setback is required from the high water marks of the vernal pools shall be <br /> required. <br /> e. No excavation shall take place within twenty-five(25)feet of any property line or right-of-way <br /> (nor within the allowed slopes adiacent to -said twenty-five (25) foot setback), unless the <br /> elevation prior to excavation is more than that of the abutting property, in which case the <br /> elevation within said twenty-five (25) foot setback shall at no time be less than that of the <br /> abutting property, at the property line (Development Title Section 9-1415.3fi1) <br /> f. The maximum daily truck trips shall be 100. <br /> g. The plant and the open pit shall not be visible from Waverly Road. This shall be <br /> accomplished by berms and landscaping. (Section 9-2244(o)). <br /> h. No stockpiled soil or material shall be placed closer than 25 feet to a property boundary <br /> (Section 9-2244 (b))_ <br /> i. All private roads shall be maintained to control the creation of dust. <br /> j. Any night lighting established on the property shall be arranged and controlled to not <br /> illuminate public rights-of-way or adjacent properties (Section 9-2244 (g)). <br /> k. The topsoil shall be set aside, and upon completion of an excavation, the topsoil shall be <br /> replaced and the site leveled in conformance with the excavation permit (Section 9-2244 <br /> (i)). <br /> I.
