This is a Class [] violation. 102 CCR 66262.11, 66262.40(c) Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 years. Metal fines are being generated from a metal grinder, located inside (adjacent to the shop entrance).This metal grinder is being used to resurface brake rotors and metal fines generated by this equipment(according to Mr. Magana) are being recycled as scrap metal without first determining particle size or hazardous properties. Metal fines were observed inside the particle collector, as well as on top of the equipment, and on the floor in its immediate vicinity; some metal fines appeared to be contaminated by an oily liquid. Mr. Magana stated that it will be more cost effective for his business to discontinue the practice of utilizing the metal grinder. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal fines, make a hazardous waste determination for the metal fines, and manage it according to Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste.
