An emergency coordinator and modified contingency plan information is lacking. There must be at least one emergency coordinator on site or on call to coordinate emergency response measures, and the following information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required information by a phone. A form is provided that can be used for this purpose. This is a repeat violation, Class II. 109 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. Copies of uniform manifests for the disposal of hazardous waste were not found on site. Mr. Magana stated that his bookkeeper has all his disposal records at an offsite location. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately locate a copy of all manifests and receipts for the last three years, maintain them on site, and submit copies to the EHD. This is a Class II violation. 112 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. Copies of hazardous waste disposal records were not found on site. Bills of lading or manifests for the management of lead acid batteries for the last three years were not found on site. A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the EHD. This is a Class II violation. 116 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was conducted at this facility on May 11, 2009 and a report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by June 11, 2009. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. 117 HSC 25404(e)(4) Failed to report program data electronically, A submission to the California Electronic Reporting System (CERS) for the hazardous waste program has not been made. While onsite, the inspector assisted in creating a CERS account, however, since the account confirmation email has not received in a timely manner,was not able to assist further with the CERS submittal. Beginning January 1, 2013, all businesses are required to submit all new (or any changes to existing) hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required fields. This is a Class II violation.
