May 30, 2000 <br />TO: Dennis Fields, Assistant Coordinator of Hazardous Materials <br />San Joaquin County Office of Emergency Services <br />SUBJECT: Eddie's Pizza <br />Per your request, this is the best of my recollection regarding George Badway: <br />12/3/98 - Badway called and asked what was he supposed to do with the phone book that I sent <br />him. I told him I did not send him a phone book. He became irate and started yelling that he had a <br />degree in chemistry and he was unable to understand everything that was in this (the plan). I asked <br />Badway which elements of the plan he was having trouble with and he said the whole damn thing <br />and that he did not have a law library. I told Badway that I was available to assist him. He began <br />screaming into the phone and I was unable to understand much of what he was yelling, however, I <br />did recognize the profanity. I told him that the call was about to end if he continued the cussing any <br />longer. I also told him the plans were past due and that I would be sending a warning letter. <br />12/16/00 - A verification inspection of the El Dorado St. facility revealed four 50 and one 20 <br />pound CO2 cylinders. One of the 50 pound cylinders was empty. The manager said that the bulk <br />storage tank of CO2 was removed on 12/15/98. <br />12/16/98 - During a verification inspection at the Waterloo Road Restaurant I observed seven, high <br />pressure, CO2 cylinders in what I would describe as a storage closet located close to the back door <br />of the restaurant. Six of the cylinders I recognized as 50 pound cylinders and each had a small <br />round sticker with "50 lbs." printed on it and attached to the neck of the bottle. The other was a <br />cylinder that I recognized as a 20 pound cylinder. I tilted each of the cylinders to ascertain the <br />weight. Five of the 50 pound cylinders were heavy and did not feel empty. One of the 50 pound <br />cylinders felt much lighter than the others and did feel empty. The 20 pound cylinder felt empty <br />also. Badway said the cylinders were empty and I attempted to show him, by pressing my thumb <br />against the outlet and opening the valve that the cylinder contained high enough pressure that I <br />would be unable to keep the gas from escaping. I explained that it is easy to keep the gas from <br />escaping for cylinders that are close to being empty and, therefore, have little pressure. At this point <br />Badway brushed by me and, with the outlet pointing directly at his face, attempted to do the same. <br />This resulted in the gas blowing in his face and his hair being blown back as he was also unable to <br />hold back the gas. I wrote on the inspection report that there were five full 50 pound cylinders and <br />2 empties (one 50 lb. and one 20 lb.). He demanded that I write that I did not weigh the cylinders. <br />I told him that I would write what I felt was necessary not what he demand me to write, and if he <br />wanted to write a letter stating that I didn't weigh the cylinders, he was well within his rights. He <br />became very angry and when I asked Badway to sign the report so that I could give him a copy, he <br />wrote his complaint across the report. <br />12/16/98 - A verification inspection of the Hammer Lane facility revealed four 50 pound CO2 <br />cylinders. The manager indicated that one of the cylinders was empty, however, that cylinder still <br />contained a significant amount of pressure. The manager said that the bulk storage tank of CO2 <br />was removed the week of 12/7/98. <br />11/1/99 - A verification inspection of the Hammer Lane facility revealed four 50 pound CO2 <br />
