The <br /> last Emergency Response Procedure submittal was on 11/17/2016. The emergency response procedures were not <br /> completed with all the required elements.The consolidated emergency response/contingency plan did not contain <br /> the phone number to the SJC Environmental Health Department/CUPA(209)468-3420 for spill/releases notification. <br /> . A business plan shall be submitted annually and include the following emergency response procedures for a <br /> release or threatened release of hazardous materials, including, but not limited to,the following: <br /> -immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice,for the site <br /> Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 8 HSC 25505(a)(4) Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program was not submitted annually as part of the business plan. The last training program submittal was <br /> on 11/17/2016. Training programs for all employees and annual training, including refresher courses, shall include <br /> familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened <br /> release of a hazardous material and should be submitted annually as part of the business plan. Training shall cover, <br /> but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 9 HSC 25508(a)(1) Failed to annually review and certify that the business plan is complete, accurate, and up to date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS)annually.The last business plan submittal was on 11/17/2016.The facility did not submit a <br /> business plan for 2018, and 2019. The business plan shall be submitted by January 15 of each calendar year and <br /> may be submitted beginning November 1 of the previous year. Immediately log into the CERS at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> On site to conduct a Hazardous Materials Business Plan (HMBP) inspection.
