Ilwy 99 #92 <br /> Acampo, CA 95220 <br /> Dear Mr. Bruner, <br /> I am in receipt of your letter dated August 15, 1998, which you delivered to my home <br /> on September 3, 1998. <br /> In this letter you propose to destroy the well that supplies my home and the Ornelas <br /> household (770 East Augusta) with domestic water. When I purchased this home in <br /> August of 1997, it was represented to me by the seller that a long standing Agreement <br /> has existed between the owners of the three properties involved (760, 770 and 780 East <br /> Augusta) which assigns certain ownership rights and entitlements to the water well in <br /> question. Upon my request, Mr. Bender sent me a copy of this Agreement. <br /> It is my position that the existing domestic water well is an intrinsic asset of the property <br /> I purchased, and that the value of my property would be greatly diminished if it were to <br /> be lost. I also note that Mr. Bender has honored the Agreement by sending me electric <br /> bills for operation of the well, and I have honored the Agreement by paying them. Also, <br /> both Mr. Ornelas and I have periodically repaired and maintained the well. <br /> If any individual or agency wishes to acquire this asset or otherwise cause me to lose my <br /> existing source of water, I must be compensated for the cost of a replacement domestic <br /> water system.
