10 . 0 THE RECLAMATION PLAN <br /> Please refer to Appendix 11. 2 for the completed Reclamation Plan <br /> Form. <br /> The SMARA defines "Reclamation" as the combined process of land <br /> treatment that minimizes water degradation, air pollution, damage <br /> to aquatic or wildlife habitat, flooding, erosion, and other <br /> adverse effects from surface mining operations, so that mined lands <br /> are reclaimed to a usable condition which is readily adaptable for <br /> alternate land uses and creates no danger to public health and <br /> safety. <br /> The SMARA requires that mining applicants submit a Reclamation Plan <br /> to, and receive approval of the plan by, the Lead Agency prior to <br /> commencement of operations. <br /> California Code of Regulations, Title 14, Chapter 8 , Article 1, <br /> Section 3502 (b) (1) requires that the Reclamation Plan contain a <br /> description of the environmental setting of the site of operations <br /> and the effect that possible alternate reclaimed site conditions <br /> may have upon the existing and future uses of the surrounding land. <br /> CEQA Section 15125 requires a description of the environment in the <br /> vicinity of the project, as it exists before the commencement of <br /> the project, from both a local and a regional perspective. <br /> "Environment" (CEQA Sec. 21060. 5) is defined as the physical <br /> conditions which exist within the area which will be affected by a <br /> proposed project, including land, air, water, minerals, flora, <br /> fauna, noise, and objects of historic or aesthetic significance. <br /> 36 *%� <br /> CONDOR <br />
