Hazelton Avenue <br /> Stockton, California 95205 <br /> Attention: Mr. Garrett Becker, Chairman <br /> Re : Revised Recommendation- Stockton <br /> Sand & Gravel EIR (EIR-81-5/EP-81-9) <br /> (9/28/81) <br /> Dear Mr. Becker: <br /> Due to the fact that we had very little time to comment <br /> on the Revised Recommended Conditions of staff which were <br /> presented at the last public hearing of this matter, the <br /> following is submitted in the form of written comments on <br /> the new proposed conditions . <br /> Regarding proposed Condition No . 1 that the permit <br /> shall expire three years from the date of approval it is my <br /> clients position that 3 yrs .is too short a period of time to <br /> justify the economic cost incurred in spending money to move <br /> their operation to the new site . All other excavation <br /> permits given to competing sand and gravel operations in <br /> this county are for a period of 5 years . <br /> Regarding proposed Condition No . 2 the first sentence <br /> is O .K, that is; that all proposed excavation and rehabilitation <br /> shall be completed prior to the expiration of the permit, <br /> however, my client must have project related storage in Area <br /> 4 since that is now part of the revised plan. <br /> Regarding proposed Condition No . 3 it is our position <br /> that there is no need to vary the Standard Conditions for <br /> Excavation currently in effect in this county which allow <br /> sand and gravel operations to operate from 5 : 00 A .M. until <br /> 9 : 00 P.M. The construction industry usually starts their <br /> operations at 8: 00 a .m. and we must have our' customer 's trucks <br /> loaded and on the job site by 8 : 00 a.m. Due to the location of <br /> our plant and the distance the material must be hauled to the <br /> various job sites ft is imperative that my client 's customers <br /> be able to load their trucks in accordance with the Standard <br /> Quarry Excavation Conditions . <br />
