It will be most difficult for <br /> my client to comply with that condition. Other sand and <br /> gravel operations in this county are given a t,•ro year period <br /> within which to complete the same work. <br /> Regarding Condition No. 5, this should be deleted as <br /> a new site plan has now been filed. <br /> Regarding proposed Condition No . 6 , on behalf of my <br /> client we would like to request that this be revised to read <br /> as follows : <br /> "Operating practices shall be utilized at all times <br /> to minimize any adverse effects of noise, vibration, <br /> and dust caused by the excavation minimizing them <br /> to acceptable levels . " <br /> Regarding Condition No . 7, there is no guarantee there <br /> is currently 24" of soil present . My client expects to find <br /> additional soil under the rock piles but we do not want the <br /> permit to specify 24" of top soil if there isn't any there <br /> in the first place. The condition should be revised to read <br /> as follows : <br /> "Areas covered by this permit shall be rehabilitated <br /> to the greatest extent possible using overburden materials <br /> available in the excavation area and the area shall be <br /> C) <br /> such that the site can be used for agriculture <br /> or other uses . " <br /> Condition No. 8 is O .K. <br /> Condition No . 9 . : The amount recommended is discriminatory <br /> when compared to other competitors in the County . My client <br /> has had a $10,000 . 00 performance bond on other permits and <br /> these have never been called. There is no need to increase <br /> the bond. It is anticipated that there will actually be less <br /> trucks involved in the new proposed operation than were <br /> using the County' s roads at the Calaveras River site, therefore, <br /> my client sees no reed for any new bond to corer road rehabilitation. <br /> Before expiration of our current permit , Stockton Sand and <br /> Gravel will have complied with all of the conditions thereof . <br /> Regarding Condition '1o . 10, refer to page AA6 of the <br /> EIR report . As proposed, Condition No . 10 does not meet the <br /> econo:".i,, or engineering realities of a project .such as this. <br /> From an engineering standpoint you really cannot start <br /> rehabilitation of an area until you have completed excavating <br /> it and that depends upon the supply which the local construction <br /> industry demands. Even after completing excavation, rehabilitation <br /> cannot be completed to 100% since access will be needed into <br />
