On five <br /> occasions ( 5/9/88 , 3/28/88 , 12/27/37 , 10/4/87 and 8/31/87 ) , <br /> the City invalidated the bioassay because of fish survivals <br /> below 70% in less than 96-hours and restarted the test even <br /> though the control did not have a concurrently low survival <br /> rate. These five early invalidations result in each of the <br /> violations marked with an asterisk to be suspect. <br />
