WASTE DISCHARGE REQUIREMENTS <br /> CITY OF TRACY <br /> WASTEWATER TREATMENT PLANT <br /> SAN JOAQUIN COUNTY -3- <br /> Joaquin Delta in the future which may have an affect on the flows in Old <br /> River. If the flow regime of Old River is significantly changed, or is <br /> found to be significantly different than the flow used to develop permit <br /> limits, the permit will be reopened for modification of effluent limits. <br /> See Provision F.6. <br /> 14. The Discharger is conducting a pilot study for reuse of sludge at <br /> agronomic rates on cropland owned by the Discharger. If the pilot study <br /> shows that such reuse is viable, a separate set of waste discharge <br /> requirements will be developed for the sludge reuse/disposal . <br /> 15. The action to adopt an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section <br /> 21000, et seq. ) , in accordance with Section 13389 of the California <br /> Water Code. <br /> 16. The Board has notified the Discharger and interested agencies and <br /> persons of its intent to prescribe waste discharge requirements for this <br /> discharge and has provided them with an opportunity for a public hearing <br /> and an opportunity to submit their written views and recommendations. <br /> 17. The Board, in a public meeting, heard and considered all comments <br /> pertaining to the discharge. <br /> 18. This Order shall serve as an NPDES permit pursuant to Section 402 of the <br /> Clean Water Act, or amendments thereto, and shall take effect ten days <br /> from the date of hearing, provided EPA has no objections. <br /> IT IS HEREBY ORDERED that Order No. 85-214 be rescinded and that the City of <br /> Tracy, in order to meet the provisions contained in Division 7 of the <br /> California Water Code and regulations adopted thereunder, and the provisions <br /> of the Clean Water Act and regulations and guidelines adopted thereunder, <br /> shall comply with the following: <br /> A. Discharge Prohibitions: <br /> 1 . The discharge or by-pass of wastes, partially treated waste or <br /> effluent to Sugar Cut, Tom Paine Slough, or Paradise Cut is <br /> prohibited. <br /> 2. The discharge to surface waters other than to Old River is <br /> prohibited. <br /> 3. The bypass of wastes to Old River is prohibited, except as allowed <br /> by Standard Provision A. 12. <br />
