1� V WASTE DISCHARGE REQUIREMENTS CITY OF TRACY SAN JOAQUIN COUNTY -3- 14. The action to adopt an NPDES permit is. exempt from the provisions of the California Environmental Quality Act (Public Resources Code Section 21000, et seq.) , in accordance with Section 13389 of the California Water Code. 15. The Board has notified the Discharger and interested agencies and persons of its intent to prescribe waste discharge requirements for this discharge and has provided them with an opportunity for a public hearing and an opportunity to submit their written views and recommendations. 16. The Board, in a public meeting, heard and considered all comments pertaining to the discharge. 17. This Order shall serve as an NPDES permit pursuant to Section 402 of the Clean Water Act, or amendments thereto, and shall take effect ten days from the date of hearing, provided EPA has no objections. IT IS HEREBY ORDERED that the City of Tracy, in order to meet the provisions contained in Division 7 of the California Water Code and regulations adopted thereunder, and the provisions of the Clean Water Act and regulations and guide- lines adopted thereunder, shall comply with the following: A. Previous Orders: 1. Order 77-182 (CAO079154) and Order 81-076 are hereby rescinded. 2. Cease and Desist Orders 78-52, 79-54, 79-123, and Order 80-097 pertaining to the City of Tracy shall remain in full force and effect. B. Prohibitions: 1. The discharge or by-pass of wastes, partially treated waste or effluent to Sugar Cut, Tom Paine Slough, or Paradise Cut is prohibited. 2. The discharge to surface waters other than to Old River is prohibited. C. Effluent Limitations: 1. The discharge of an effluent in excess of the following limits is pro- hibited prior to completion of the 9.0 mgd treatment facility: Average Average 30-day Daily Constituents Units Monthly Weekly Median Maximum BOD1 mg/l 20 40 --- 50 lbs/day* 915 1835 --- 2295 kg/day* 415 830 --- 1040
