1� V <br /> WASTE DISCHARGE REQUIREMENTS <br /> CITY OF TRACY <br /> SAN JOAQUIN COUNTY -3- <br /> 14. The action to adopt an NPDES permit is. exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section 21000, et <br /> seq.) , in accordance with Section 13389 of the California Water Code. <br /> 15. The Board has notified the Discharger and interested agencies and persons of <br /> its intent to prescribe waste discharge requirements for this discharge and <br /> has provided them with an opportunity for a public hearing and an opportunity <br /> to submit their written views and recommendations. <br /> 16. The Board, in a public meeting, heard and considered all comments pertaining <br /> to the discharge. <br /> 17. This Order shall serve as an NPDES permit pursuant to Section 402 of the <br /> Clean Water Act, or amendments thereto, and shall take effect ten days from <br /> the date of hearing, provided EPA has no objections. <br /> IT IS HEREBY ORDERED that the City of Tracy, in order to meet the provisions <br /> contained in Division 7 of the California Water Code and regulations adopted <br /> thereunder, and the provisions of the Clean Water Act and regulations and guide- <br /> lines adopted thereunder, shall comply with the following: <br /> A. Previous Orders: <br /> 1. Order 77-182 (CAO079154) and Order 81-076 are hereby rescinded. <br /> 2. Cease and Desist Orders 78-52, 79-54, 79-123, and Order 80-097 pertaining <br /> to the City of Tracy shall remain in full force and effect. <br /> B. Prohibitions: <br /> 1. The discharge or by-pass of wastes, partially treated waste or effluent to <br /> Sugar Cut, Tom Paine Slough, or Paradise Cut is prohibited. <br /> 2. The discharge to surface waters other than to Old River is prohibited. <br /> C. Effluent Limitations: <br /> 1. The discharge of an effluent in excess of the following limits is pro- <br /> hibited prior to completion of the 9.0 mgd treatment facility: <br /> Average Average 30-day Daily <br /> Constituents Units Monthly Weekly Median Maximum <br /> BOD1 mg/l 20 40 --- 50 <br /> lbs/day* 915 1835 --- 2295 <br /> kg/day* 415 830 --- 1040 <br />
