CEASE AND DESIST ORDER <br /> CITY OF TRACY <br /> Report of <br /> Task Compliance Due <br /> d. Prepare and submit a technical report evaluating 15 Dec 1978 <br /> existing domestic and industrial wastewater <br /> treatment and disposal capacity and establishing <br /> a plan and a time schedule for permanent treat- <br /> ment plant expansion and/or growth restrictions <br /> to assure adequate capacity and continuous <br /> compliance with waste discharge requirements. <br /> 3. Additional discharges to the sewer system by industrial dischargers who <br /> did not discharge into the system prior to 28 April 1978 are prohibited; <br /> provided the following are excluded from this provision: (a) projects <br /> under construction or which were issued building permits before 12 April <br /> 1978; (b) projects which would eliminate discharges from existing <br /> industries which have waste disposal systems causing more severe water <br /> quality problems than those caused by the City of Tracy Wastewater <br /> Treatment Plant; or (c) projects which would alleviate an extreme public <br /> hardship or a public health problem. <br /> 4. If, in the opinion of the Executive Officer, the City of Tracy fails to <br /> comply with the provisions of this Order, the Executive Officer is directed <br /> to request the Attorney General to take the appropriate enforcement action <br /> against the discharger, including injunction and civil monetary remedies , <br /> if appropriate. <br /> I, JAMES A.
