CEASE AND DESIST ORDER <br /> CITY OF TRACY <br /> 8. The City of Tracy has not adequately enforced City Ordinance 395 C.S. and <br /> has thus violated Provision E.2 of Order No. 77-182 listed in Finding 2 <br /> above. <br /> 9. Any increase in the discharge of industrial waste will increase the <br /> violation or likelihood of violation of waste discharge requirements <br /> and will further unreasonably impair water quality. <br /> 10. On 6 March 1978, the City Council of the City of Tracy adopted Resolution <br /> No. 3069 approving additional facilities to provide: treatment and disposal <br /> capacity for excess waste activated sludge, industrial BOD, and suspended <br /> solids; and resolving to take further action to meet waste discharge <br /> requirements if these facilities are not operational by 1 July 1978. <br /> 11. On 28 April 1978, at the American Legion Hall , 1960 Tracy Boulevard, Tracy, <br /> the Board conducted a public hearing at which the discharger appeared and <br /> evidence was received concerning the discharge. <br /> 12. Issuance of this Order is exempt from the provisions of the California <br /> Environmental Quality Act (Public Resources Code Section 21000, et seq. ) , <br /> in accordance with Section 15108, Chapter 3, Title 14, California <br /> Administrative Code. <br /> IT IS HEREBY ORDERED THAT: <br /> 1. The City of Tracy Wastewater Treatment Plant cease and desist forthwith <br /> from discharging and threatening to discharge wastes contrary to require- <br /> ments listed in Finding 2 above. <br /> 2. The City of Tracy shall comply with Order No. 77-182 according to the <br /> following time schedule: <br /> Report of <br /> Task Compliance Due <br /> a. Submit status report describing equipment 15 May 1978 <br /> requiring repair or replacement and a time <br /> schedule leading to correction prior to canning <br /> season. The disinfection and dechlorination <br /> facilities must be specifically addressed. <br /> b. Complete plans and specifications for interim 22 May 1978 <br /> plant improvements to provide additional treat- <br /> ment capacity, and begin construction. <br /> C. Interim plant improvements and existing plant 17 Jul 1978 <br /> facilities to be fully operational . <br /> - 3 - <br />
