Locke, City Manager <br /> Subject: City of Tracy Wastewater Treatment Facility <br /> Gentlemen: <br /> NOTICE REGARDING <br /> SECTION 2244.1 , SUBCHAPTER 9.1 , CHAPTER 3 , TITLE 23 <br /> CALIFORNIA ADMINISTRATIVE CODE <br /> The attached notice of public hearing provides that a hearing will be held by <br /> a regional water quality control board to consider issuance of a cease and <br /> desist order and that the board also will consider whether to prohibit or <br /> restrict the additional discharges of industrial waste to the sewer system. <br /> Section 2244.1 (a) of Subchapter 9.1 , Chapter 3, Title 23 of the California <br /> Administrative Code, provides that the Board should exclude from any such <br /> prohibition or restriction " . . .projects under construction or with building <br /> permits already issued at the time of the notice of the cease and desist <br /> hearing to consider the proposed prohibition or restriction was given unless <br /> special circumstances justify inclusion of such projects ." Therefore , any <br /> building permit issued by the community whose discharge is the subject of <br /> the hearing, subsequent to receipt of this notice, should contain a notifi- <br /> cation that the permittee may not be allowed to connect to the community <br /> sewer system if the prohibition or restriction is adopted and is still in <br /> effect when connection is desired. <br /> `S'incerely, <br /> WILLIAM S.
