Recommendations <br />Action <br />It is recommended that the Planning Commission: <br />I. Modify Site Approval No. PA-1600172 based on the ability to make grounds for revocation <br />pursuant to Development Title Section 9-230.4(c) as contained in the Staff Report. <br />2. Modify the conditions of approval for Site Approval No.PA-1600172 as contained in the Staff <br />Report. <br />Grounds for Revocation <br />Fraud That such development approval was obtained or extended by fraud, <br />This determination cannot be made. The Property owner met all prerequisites of the Site <br />Approval application and obtained approval from the Community Development Department. <br />There is no evidence or allegation that the approval was obtained or extended by fraud. <br />Violation of Condition. That one (1) or more of the conditions upon which such development approval <br />was granted have been violated; or <br />This determination cannot be made. The Community Development Department Code <br />Enforcement division's investigation has determined that the Property is not currently in <br />violation of the approved land use permit. Condition of Approval 1. b. of Site Approval No. <br />PA-1600172 states: <br />1.b. APPROVED USE: This approval is for the parking of one (1) truck and two (2) trailers only, <br />as shown on the site plan dated July 19, 2016 (Use Type: Agricultural Truck Parking- <br />Accessory use in the agricultural zone). <br />Adverse Impacts. That the use or facility for which the development approval was granted is so <br />conducted or maintained as to be detrimental to the public health or safety, or as to be a public <br />nuisance. <br />This determination can be made. The Property is surrounded by small parcels that contain <br />residences. At the time of the initial review of the land use application, compatibility of truck <br />parking with surrounding land uses was not identified as a concern. However, numerous <br />complaints have since been received by the Department regarding the noise and the size of <br />the trucks parked on site (STAA). As a result, compatibility with surrounding land uses has <br />since become an issue.
