SUMMARY OF VIOLATIONS (CLASS I,CLASS II, or MINOR-Notice to Comply) Onsite to conduct a routine UST inspection and observe Monitoring System Certification conducted today. A checklist was left onsite at the time of inspection, and a complete report was delivered to the facility on August 21, 2013. A cold start inspection for the SR0067435 was also conducted on August 15, 2013 (post software upgrade on the Veeder Root system). All system functions were verified, a copy of the alarm history was submitted to the EHD. Class II Violations: (303, 313, 404, and 406): 303. The 87-octane STP sump sensor was located approximately 2-inches up the saddle of the tank sump, the 87 fill sump sensor was located approximately 2-feet up the saddle of the tank sump, and the diesel fill sump sensor was located approximately 1-foot up the saddle of the tank sump. These sensors were not located to detect a leak at the earliest opportunity. Monitoring equipment shall be maintained to be able to detect a leak at the earliest possible opportunity. The technician repositioned all the sensors to the lowest points of the respective sumps. CORRECTED. 313. The 91-octane spill container failed when tested. All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. The technician replaced the outer O-ring of the spill container, retested and it passed. A retrofit verification with the inspector already onsite was filled out and a copy provided to the store manager at the time of the inspection. CORRECTED. 404. Water was found in the 87-octane fill sump (approximately 4 gallons), diesel fill sump (approximately 1 gallon), 87-octane STP (approximately 2 cups), 91 STP sump (approximately 1.5 quarts), and in the vent sump (approximately 0.5 cup). Technician removed the liquid from above sumps and retained for disposal. According to the reviewed site records, approximately 100-gallons was removed from the onsite sumps on 12-10-12, approximately 150-gallons were removed from the 87-fill sump on 12-26-12, and approximately 230-gallons were removed from the 87-fill sump on 01-08-13. Secondary containment shall be constructed to prevent any water intrusion into the system by precipitation, infiltration, or surface runoff. Immediately contact a properly licensed, trained, and certified contractor to address the water intrusion into the onsite sumps under permit and inspection of the EHD. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
