Board of Housing Appeals Me,ong <br /> Staff Report — 2156 South B Street, Stockton <br /> III. Abstract <br /> On August 16, 2013, the Environmental Health Department, along with Montezuma Fire <br /> Chief Ed Martel, conducted an exterior inspection and found one single family dwelling and <br /> one detached shed with substandard conditions. The structures were posted for violations <br /> of State Housing Law, including lack of water heater, lack of electrical lighting, general <br /> dilapidation, improper maintenance, unsanitary conditions, hazardous wiring, inadequate <br /> mechanical, sagging roof and ineffective waterproofing of exterior walls, materials of <br /> construction are inadequate, accumulation of weeds, and unsafe building due to inadequate <br /> maintenance. The shed was also found to be unsecured in violation of Section 8-5601 of <br /> the San Joaquin County Ordinance Code and was posted with a Notice to Secure. <br /> The Environmental Health Department conducted an inspection on October 14, 2013, in <br /> response to a structure fire incident report from Montezuma Fire District, and observed the <br /> posted shed had been completely damaged by fire. <br /> A review of the San Joaquin County Environmental Health Department records showed a <br /> septic destruction permit was obtain on January 24, 1994 but had expired with no <br /> inspections. Records also showed that the structures had been previously posted as <br /> substandard on September 17, 2004 with the violations corrected and the case closed on <br /> April 30, 2007. <br /> A check of the Community Development and Environmental Health Department's <br /> databases showed that no building or septic destruction permits had been issued to correct <br /> current violations at the property. <br /> From November 05 through 07, 2013, EHD staff has received calls from Mr. Ahmed <br /> Shaker, who has presented his interest in purchasing and rehabilitating the property. <br /> This case is being brought before the San Joaquin County Board of Housing Appeals to <br /> determine a reasonable and feasible schedule for expeditious repair or demolition and to <br /> authorize the San Joaquin County Environmental Health Department to proceed with <br /> demolition of remaining structure should the violations fail to be corrected within the <br /> determined time schedule. <br /> IV. Violations <br /> On August 16, 2013, the following violations of the California Health and Safety Code, <br /> Section 17920.3, were observed for the Single Family Dwelling (SFD): <br /> 1. Lack of hot running water to plumbing fixtures in a dwelling unit [subsection a.5)] <br /> 2. Lack of required electrical lighting [subsection (a.6)] <br /> 3. General dilapidation or improper maintenance [subsection (a.13)] <br /> 4. Unsanitary conditions [subsection (a)] <br /> 5. Members of ceilings, roofs, ceilings and roofs support, or other horizontal members <br /> which sag, split, or buckle due to defective material or deterioration [subsection <br /> (b.6)] <br /> 6. Nuisance [subsection (c)] <br /> 7. Hazardous or inadequate wiring [subsection (d)] <br /> Page 2 of 4 <br />
