CONDITIONS OF APPROVAL <br /> MS-99-12 <br /> Nannizzi <br /> Minor Subdivision Application No. MS-99-12 was approved by the San Joaquin County Community <br /> Development Department on August 18, 1999. The effective date of approval is August 28, 1999. <br /> This tentative map approval will expire on August 27, 2002, which is three years from the effective <br /> date of approval,unless(1)all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Tina Wehrmeister,468-8477) <br /> a. TENTATIVE MAP: The parcel map shall be in substantial conformancewith the approved Tentative <br /> Map dated July 2, 1999. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 2 shall have a minimum lot width of 33.21 feet. (DevelopmentTitle Section 9- <br /> 1015.4(h)(1)). <br /> (2) Parcels land 2 shall have a minimum lot area of 4.5 acres. (Deviation Application No. DV-98-5, <br /> approved December 24, 1999) <br /> c. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) The existing driveway providing access to Parcel 1 shall be relocated to be entirely within the <br /> road frontage for Parcel 1. <br /> 2. DEPARTMENTOF PUBLIC WORKS (See attached memo dated August 10, 1999.) <br /> 3. PUBLIC HEALTH SERVICES (See attached memo dated July 26, 1999.) <br /> 4. PARK FEES: Due to the relatively small size of the subdivision,less than fifty(50)parcels,the San <br /> Joaquin County Departmentof Parks and Recreation will require the collection of in-lieu fees for park <br /> development as a requirement for approval of the Map. (Development Title Section 9-1230.8) <br /> 5. COUNTYCOUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code,the <br /> subdivider shall defend, indemnify,and hold harmless the local agency or its agents,officers,and <br /> employees from any claim,action,or proceeding against the local agency or its agents,officers,or <br /> employees to attack,set aside,void,or annul an approval of the local agency,advisory agency, <br /> appeal board,or legislative body concerning a subdivision,which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br />
