July 21, 1999 <br /> NOA ENVIRONMENTAL PROJECT NUMBER E99130 <br /> A. INTRODUCTION <br /> Due to concerns regarding potential liability for toxic hazards which may adversely impact real estate <br /> in general, owners need to assess the property in question to determine if current or past occupants <br /> or surrounding land uses could adversely impact property development or result in future liability for <br /> the investor. Good commercial and customary practice for conducting an environmental site <br /> assessment of a parcel of property is to identify recognized environmental conditions. The term <br /> "recognized environmental conditions" means the presence or likely presence of any hazardous <br /> substances or petroleum products on a property under conditions that indicate an existing release, a <br /> past release, or a material threat of a release of any hazardous substances or petroleum products into <br /> structures, onto the property or into the ground, groundwater, or surface water of the property. <br /> B. LIMITATIONS <br /> This report was compiled as a Surface and Subsurface Contamination Report for the subject project. <br /> This report contains information and data provided to NOA ENVIRONMENTAL by several <br /> sources. NOA ENVIRONMENTAL in no way warrants the accuracy or completeness of the <br /> information provided to this investigation by those sources. <br /> It should be noted that when an assessment is completed without sample collection and quantitative <br /> analysis of soil and groundwater beneath the site, as in this study, no statement of scientific certainty <br /> can be made regarding latent subsurface conditions which may be the result of on-site or off-site <br /> sources. The findings and conclusions of this report are not scientific certainties, but rather, <br /> probabilities based on professional judgement concerning the significance of the data gathered during <br /> the course of this investigation. NOA ENVIRONMENTAL is not able to represent that the site or <br /> adjoining land contains no hazardous waste, oil, underground storage tanks, or other latent condition <br /> beyond that detected or observed by NOA ENVIRONMENTAL during the Surface and Subsurface <br /> assessment. The possibility always exists for contaminants to migrate through surface water, air, or <br /> groundwater. <br /> Our office has not been provided with specific criteria for the development of this report other than <br /> a request to evaluate the property in question for possible problems related to toxic or hazardous <br /> agents, nor have we been directed to address any specific questions concerning the site. Should there <br /> be a need to conduct an investigation into a specific question not addressed in this report, contact our <br /> office immediately regarding your concerns. <br /> 2 <br />
