CONDITIONS OF APPROVAL <br /> MS-99-11 <br /> Trimark <br /> Minor Subdivision Application No. MS-99-11 was approved by the San Joaquin County Community <br /> Development Department on August 3, 1999. The effective date of approval is August 13, 1999. This <br /> tentative map approval will expire on August 12, 2002,which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact::Jeff Fisher,468-9653) <br /> a. TENTATIVE MAP: The Parcel Map shall be in substantial compliance with the Tentative Map dated <br /> June 24, 1999. <br /> b. DEVELOPMENT: Development of the parcels shall comply with the following: <br /> (1) A Notice of Subdivision Restriction shall be placed on the Parcel Map and recorded as a <br /> separate instrument that restricts the development of Parcels One and Two until they are further <br /> subdivided. Parcels Three and Four are to be developed for public purposes and will not require <br /> further subdivision prior to development. <br /> (2) A Note shall be included on the Parcel Map, for Parcels One and Two, stating that all <br /> requirements specified in Exhibit D of the Mountain House Development Agreement,the Master <br /> Plan, and Specific Plan I that are to be fulfilled prior to the First Development Permit shall be <br /> satisfied before any additional subdivision or development can occur on parcels shown on the <br /> Parcel Map, unless waived by the Board of Supervisors. At the time Parcels One and Two are <br /> resubdivided,additional conditions may be imposed to reflect development conditions, pattern, <br /> and density. <br /> (3) All development on Parcel Three is subject to the Conditions of Approval and Mitigation <br /> Monitoring Program for Use Permit Application No. UP-98-16. <br /> c. PRELIMINARY MAP: This map is to be processed as a Preliminary Map per Section 17.7[2][b] <br /> of the Mountain House Master Plan. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision,which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> Conditions of Approval - 1 - MS-99-11 <br />
