CONDITIONS OF APPROVAL MS-99-11 Trimark Minor Subdivision Application No. MS-99-11 was approved by the San Joaquin County Community Development Department on August 3, 1999. The effective date of approval is August 13, 1999. This tentative map approval will expire on August 12, 2002,which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified,and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact::Jeff Fisher,468-9653) a. TENTATIVE MAP: The Parcel Map shall be in substantial compliance with the Tentative Map dated June 24, 1999. b. DEVELOPMENT: Development of the parcels shall comply with the following: (1) A Notice of Subdivision Restriction shall be placed on the Parcel Map and recorded as a separate instrument that restricts the development of Parcels One and Two until they are further subdivided. Parcels Three and Four are to be developed for public purposes and will not require further subdivision prior to development. (2) A Note shall be included on the Parcel Map, for Parcels One and Two, stating that all requirements specified in Exhibit D of the Mountain House Development Agreement,the Master Plan, and Specific Plan I that are to be fulfilled prior to the First Development Permit shall be satisfied before any additional subdivision or development can occur on parcels shown on the Parcel Map, unless waived by the Board of Supervisors. At the time Parcels One and Two are resubdivided,additional conditions may be imposed to reflect development conditions, pattern, and density. (3) All development on Parcel Three is subject to the Conditions of Approval and Mitigation Monitoring Program for Use Permit Application No. UP-98-16. c. PRELIMINARY MAP: This map is to be processed as a Preliminary Map per Section 17.7[2][b] of the Mountain House Master Plan. 2. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of the Government Code.
